I don't think Chad did anything wrong here from the perspective of "respecting" the album or anything of the like. He was just doing what he always does when Boyd posts new media--creating MP3s and making them available to forum members. Under most circumstances, this is completely acceptable; it just so happens that the circumstances changed this time, and security will be a little tighter.

I can guarantee that Chad has the highest respect for Eisley and their work, and the time and care he puts into his fansite and the media therein is proof enough of that. He meant no disrespect by posting the MP3s.

this is a tough one. hopefully when everything gets settled we'll have some formal guidelines and it won't ever come up again. btw, things can get kind of heated at times no hard feelings whatsoever to anyone :)

My opinion doesn't really matter, but my basic understanding is that these tracks are copyright protected out the wazoo, just like they will be on the album (since.. they are the album versions). So if the label doesn't make mp3s available, I'm pretty sure it's not legal. Just like I think even recording songs off the radio and burning them to CD is illegal.

Copyright law can be a pain, and excessive sometimes, I think, but unfortunately that's pretty much where it stands I think. But, I'm not a lawyer (thank God) nor am I boyd, who I'm sure can answer this. Or even the e-merge leader.. (drawing a blank on her name).. who is now a member of these forums, apparently.

And yeah, chad is a great guy and I know he respects Eisley and their art.

Copyright protection or not, doing this could conceivably hurt Eisley... follow me here:

Warner Bros sees a huge number of listens (yes they keep track) and e-merge referrals yesterday when they first come out.

Today because everyone made/grabbed MP3s of the streams, there's not so many.

What conclusion could Warner Bros come to?

It's not really that big of a deal to just stream the songs whenever you wanna listen - at least when you're at your computer, I understand wanting to have them on your iPod, that's a different story.

I know if you're on Windows you can just add the WMA streams to your Windows Media Player playlist and it's just like having them downloaded, and I made the quicktime files so that you could throw the ref (eisley_telescopeeyes_ref.mov, etc) into iTunes on a Mac or PC and it'd play just like an MP3, while still streaming and letting WB know you're listening. (I made that bold cuz it's important)

what's confusing, and i mean this in general not just in the case of the emerge stuff, is that if streaming media is not for anyone's use at any time then why is it there in the first place? Anyone can listen to a stream as many times as they like by clicking on the link. So what is the difference, marketing aside (good point luke), for having the stream cached on your disk as a file? Wouldn't making the file available for download be the same as making a link to the stream (again marketing aside) as well? Maybe its the fact that the streams can eventually be taken down that counts. Like, in theory, with a stream you can turn it off and you turn it off for everyone. :shrug: maybe that's the point of using a stream. i dunno.

sure wish boyd would hurry back heh.

Anyway, I'm at 56k and the official streams don't work for me anyways. So this is the only way I would be able to listen to the tracks.

I can tell you one thing with absolute certainty:

As soon as these songs are available to the public, whether by stream, download, CD promo to radios/critics, etc......
as soon as someone has them, they will be available as MP3 and other file formats to download free all over the internet.

So yell at Chad, or don't yell at Chad....in a short time, it will not matter.
There will be a thousand Chads.
The Music Industry screwed up by not preventing this 15 years ago when the had the chance. Now they are all hurting in the worst sales slump they've ever been in because of file trading they cannot control.

haven't music sales actually gone up with mp3 trading?
i know i've bought tons of albums by artists i would have never heard of had it not been for it. heck, i might not even be here if i hadn't been able to download Mr Pine (yes, i know this was legal) back in the day.
i think the music industry's main problem is quality of output.
