I have heard it said that Pretender has been "abandoned" by the band... does that mean my banbd can cover it without asking permission from Eisley?

You can cover any Eisley song you want and probably not need permission, as long as you aren't recording it and distributing it for money.

The song "Pretender" is not for sale anymore, so there shouldn't be any royalties involved in covering it. For that matter, your band won't make money off of posting it on Myspace, so again there should be no royalties involved.

However, the fact that Myspace is free and that old songs are out of circulation or widely available hasn't stopped the RIAA from suing people in the past. So definitely check with Boyd to make sure there are no legal loopholes. He might have to check with Warner Brothers, which could take some time. Be prepared for a wait.

That's a stickier situation since it's on an album that's actually for sale. Royalties might come into play, the same way Radiohead can charge someone for covering "Creep" live. Definitely check with Boyd.
