I'm working on a couple screenplays for 2-3 short movies I'm going to film soon. One of them is a short horror movie (3-4 mins) and I thought that bits and pieces of Invasion would fit in perfectly. Can you do that? Well I have an iffy answer for you. Copyright holders have their own viewpoint as to what's infringement and what isn't a lot of the times. In the Star Wars realm, over the years they've allowed "fan films" to exist as long as they were not making money. If they started making money or constructed their movie in a way that left a bad impression on the franchise (i.e. porno, or film that could seriously be confused with something actually coming from LucasFilms), then they would send a Cease and Desist letter. The general rule of thumb is if it's copyrighted then do not distribute it and do not sell it. Anotherwards, make it for yourself and your immediate family only and you'll be perfectly alright. If you want to distribute it via youtube or the like, you could have your film removed if someone reports your film as copyright infringement. If you're distributing your film on your own web site, you're less likely to be hasseled so long as you're not making money. But it's still possible, if someone sees your film from Eisley's publisher, lawyers, etc...you might end up getting a C&D before you get sued. Getting sued usually happens when you're making money. You're best bet is to only use small clips, but yes you can get into trouble if you distribute it. You need to weigh that risk yourself or license the music (which I doubt you can afford to do). Yeah it is a youtube movie. My sisters and I have this obsession of filming and working in the cinema world. I'm a screenplay writer, the youngest one wants to become an actress and the othen one loves filming! LOL It would be a good way of advertising Eisley! I bet Eisley would be down with it. Unfortunately Warner Brothers, who almost certainly own the rights to the songs, would not. I recommend finding some independent band on Myspace or PureVolume, contacting them directly and obtaining their permission in writing, and using that instead. I fear these major firms - is the artist left with any freedom at all? Does your creation stay yours or does it turn into a "commercialized" and transformed reflection of what was your original idea? Freedom comes with power in this case. If you don't have the power, then you will not be able to delegate terms. Basically indies sacrifice a lot when signing with a major. They usually don't have the ability to dictate terms and their art like athletes do. Not until they become huge money makers that is. They have to take what's offered/suggested in most cases. Sad but true. Eisley pretty much has to hope that WB takes care of them and respect them as artists, which is sounds like they do. Although I'm not exactly a Hanson fan (my wife is), they are a great example of what happens when a band disagrees with their label. Now they are on their own trying to rebuild their fan base, but at least they are now able to have control of their destiny. _________________ http://www.myspace.com/keithabbott |
